Terms of Service

By using Nudge, you agree to these terms. They're standard SaaS boilerplate, written as human-readable as we could make it. Nudge is provided by Half-Baked Co. ("we", "us"). If you don't agree, please don't use the service.

You're responsible for what happens under your account, including keeping your password safe. You must be 13 or older to use Nudge (or the minimum age in your country, whichever is higher).

Nudge is a productivity tool that sends you reminders and prompts. It is not medical advice, therapy, or a substitute for professional mental health care. If you're in crisis, please contact a qualified professional or a crisis line in your country.

Don't be a jerk. Specifically, don't:

• Use Nudge to harass, threaten, or harm anyone
• Reverse-engineer, scrape, or abuse our API
• Resell or sublicense Nudge without permission
• Use it to send unlawful or infringing content

We can suspend or terminate accounts that break these rules.

Nudge is one membership — there is no free tier. Every new account starts with a 7-day free trial of the full app, with no card required. To keep using it after that, the membership is $6.99 CAD/month (about $4.99 USD) or $42 CAD/year (about $29.99 USD; USD amounts are approximate — Stripe converts at checkout). All prices are in CAD and exclude tax — applicable sales tax (for example Ontario HST) is calculated and added at checkout based on the billing address you give us.

• The 7-day trial is charge-free and needs no payment details. Nothing starts automatically: when the trial ends, app access is locked until you choose a plan.
• Once you subscribe, the membership renews automatically each period until you cancel, and you authorise us to charge your payment method each renewal.
• Cancel any time in Settings. Cancellation takes effect at the end of the period you've already paid for — you keep full access until then, after which the app locks.
• Cancelling or letting a trial lapse never deletes your account or your data — it stays put and returns the moment you subscribe.
• Monthly members can switch to annual at any time in Settings; the change is prorated by our payment processor.
• Prices are tax-exclusive: sales/VAT/GST/HST is added on top where required by your jurisdiction, calculated automatically by our payment processor from your billing address, and shown before you confirm.
• We'll give existing subscribers at least 30 days' notice before any price change, and you can cancel before it applies.
• If a payment fails we may retry and, after reasonable notice, lock app access until billing is fixed.

All payments are final and we do not offer refunds, including for partial periods or unused time. The 7-day free trial exists so you can fully try the whole app before paying anything. You can cancel any time to stop future charges, and your access continues until the end of the period you already paid for. We provide refunds only where required by applicable law. The full terms are in our Refund Policy, which forms part of these terms.

Nudge works by reaching you outside the app, so by creating an account you agree to receive nudge emails — your daily prompt, task reminders you've set, and optional goal check-ins.

• You can turn all of them off with the master switch in Settings, or turn off individual types.
• Every nudge email includes a one-click unsubscribe link.
• Service emails (password resets, security and billing notices) aren't marketing and will still be sent while your account exists.
• Email delivery depends on third-party providers and your own mail provider; we can't guarantee a nudge arrives at an exact second, so please don't rely on Nudge for safety-critical or medical reminders.

Anything you write in Nudge — brain dumps, tasks, custom prompts, goals, notes — stays yours. You grant us a limited licence to host, process, and display it solely to provide the service to you.

Several Nudge features use AI: turning a brain dump into a Today list, breaking a task into steps, suggesting a priority order across your horizons, and generating custom prompts. To do that, the text you type into those features is sent to our AI provider to produce a response.

• AI output is a suggestion, not advice. It can be wrong, odd, or comically off-base — edit or delete anything that doesn't fit.
• Don't put anything into AI features you wouldn't want processed by a third-party provider — no passwords, financial details or sensitive health information.
• AI output in Nudge is never medical, legal, financial or clinical advice.

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Nudge for your own use while your account is active. That licence does not let you:

• copy, republish or adapt our content in any other product, free or paid
• scrape the app or use it to build a dataset, model or competing service
• remove or obscure copyright, attribution or branding
• use the Nudge name, mascot or branding in a way that implies we made or endorsed your thing

Nudge, Nudges, not nags, Brain School, The Reset Room, Where Things Live, Half-Baked Co. and the brain mascot are trade marks of Half-Baked Co.. Sharing a share card or quoting a nudge with credit and a link is welcome — full details, plus how to report infringement, are on our Copyright & Trade Marks page, which forms part of these terms.

We try hard to keep Nudge running, but we don't guarantee 100% uptime. We may change, suspend, or discontinue features at any time. We'll give reasonable notice for material changes that affect paying subscribers.

Nudge is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

To the maximum extent permitted by law, Half-Baked Co. is not liable for indirect, incidental, or consequential damages. Our total liability for any claim is capped at the amount you paid us in the 12 months before the claim (or $100, whichever is greater).

You can delete your account at any time from Settings → Delete my account, or by emailing us. Deletion is permanent and immediately removes your tasks, steps, custom prompts, goals, rewards and settings, and stops all nudge emails. Backups roll off within 30 days; billing and tax records are retained only where the law requires it.

Deleting your account immediately cancels any active subscription or trial, so no further payment is taken. Cancellation is immediate rather than at the end of the period, and no refund is issued for time already paid. If we cannot cancel your subscription at that moment, we do not delete the account — we stop and ask you to try again or email us. We can also suspend or terminate accounts that violate these terms.

These terms are governed by the laws of Ontario, Canada and the federal laws of Canada applicable there. Nothing here removes mandatory consumer protection rights you have where you live, and those rights always take precedence.

We'll email you and post in-app at least 14 days before material changes take effect. Continued use after that date means you accept the new terms.
